Rumah Perlindungan (RP) ATIP
DEFINITION
Section 2 of the Anti Trafficking in Persons and Anti-Smuggling of Migrants Act 2007 (Act 670) defines trafficking in persons as all actions involved in acquiring or maintaning the labour or services of a person through coercion, and includes the act of recruiting, conveying, tranferring, harbouring, providing or receiving a person for the purpose of exploitation.
Section 2 of the Act defines the meaning of exploitation as all forms of sexual exploitation, forced labour or services, slavery or practices similar to slavery, servitude, any illegal activity or the removal of human organs.
SERVICES
The Children’s Division monitors the management and programmes implemented in the shelter homes which are gazetted as a place of refuge under the Anti Trafficking in Persons and Anti-Smuggling of Migrants Act 2007 (ATIPSOM Amendment 2007). These homes provide protection to children who are victims of human trafficking and migrant smuggling. There are two shelters that provide protection to children under the age of 18 - Rumah Perlindungan Rembau, Negeri Sembilan Shelters (for girls) and Rumah Perlindungan Bukit Senyum, Johor (for boys).

PROTECTION PROCEDURE
Enforcement officers (Immigration, Police, Customs, Malaysian Maritime Enforcement Agency and Labour Department) will bring suspected cases to the Court. If a case is identified as under ATIPSOM, an interim protection order will be issued by the Court.
If verified by the Court as a case requiring protection under ATIPSOM, the victims will be given interim protection for a period of 14 days for further investigation.
After 14 days the victims will be brought back to the Court and a Protection Order will be issued for up to three months or until the investigations are finished.
Probation Hostel
INTRODUCTION
Probation Hostel is an institution established or designated as a place for a child who is required to live there accordingly to section 61 (Probation Hostel) of the Child Act 2001.
OBJECTIVES
Provide rehabilitation to children who are involved in crime (Probation Order) and Beyond Controlled Case.
Educate children to build up positive attitudes, form strong personalities and equip them with sufficient competencies to enable them to live independently in society.
CATEGORY OF CHILDRENS
Parent or guardian’s request to the Court for Children to hold their child at the probation hostel.
Aged between ten years and above.
Be found guilty of any offense other than serious crimes, causing serious injury, raping or any offenses under the sections 377B, 377C, 377D, 377E of the penal code.
Ordered to stay in probation hostel.
ADMISSION
Court order (Court for Children) under Paragraph 91 (1) (e) or Section 46 of the Child Act 2001.
PROBATION PERIOD
During the period specified by the court.
Institusi Kebajikan Sekolah Tunas Bakti
INTRODUCTION
Approved Schools is an institutions established for education, training and detention of children designated under section 65 (approved schools) of the Child Act 2001.
OBJECTIVES
Provide rehabilitation to children who are involved with crime
Educate children to build up positive attitudes, form strong personalities and equip them with sufficient competencies to enable them to live independently in society.
Category of Childrens
Aged between ten years and above;
To be found guilty of any offenses;
Requires institutional rehabilitations; and
Offenses committed are not of serious nature but are expedient to be detained for any period and placed under any disciplinary action which found to be most beneficial to the child.
ADMISSION
Court order (Court for Children) under Paragraph 91 (1) (f) or Section 46 of the Child Act 2001.
REHABILITATION PERIOD
For a period of three years from the date of order but the detention period may be shorten by the approval of the Minister or Board of Visitors.
Institusi Kebajikan Taman Seri Puteri
INTRODUCTION
Place of Refuge (TSP) is an institutions established for the care and rehabilitation of children designated under section 55 of the Child Act 2001.
OBJECTIVES
Provide care and rehabilitation to children who are exposed to moral issues by fostering good attitudes and values that are appropriate to the norms of society.
CATEGORY OF CHILDRENS
Parent or guardian’s request to the Court for Children to hold their child at the place of refuge;
Being induced to perform any sexual act, or is in any physical or social environment which may lead to the performance of such acts;
Lives in or frequents any brothel or place of assignation;
Is habitually in the company or under the control of brothel-keepers or procurers or person employed or directly interested in the business carried on in brothels or in connection with prostitution;
Application of the child itself as it requires immediate protection;
The child is being threatened or intimidated for purposes of prostitution or for purposes of having sexual intercourse with another or for any immoral purpose;
The child is being confined or detained by another person;
Being or likely to be committed in the respect of the child
If the child is female, that she is pregnant out of wedlock.
ADMISSION
Court order (Court for Children) under Paragraph 40(1)(e) or by child own application under sub-section 41(1) of the Child Act 2001.
CARE AND REHABILITATION PERIOD
For a period of three years from the date of order but the period may be shorten by the approval of the Minister or Board of Visitors or by amending, varying or revoking the order of the Court of Children.
